In a crucial compliance update for all GST-registered taxpayers, the Goods and Services Tax Network (GSTN) has reiterated the impending deadline to file any pending GST returns older than three years, as mandated under the Finance Act, 2023.
As per the Finance Act, 2023 (No. 8 of 2023), made effective from October 1, 2023, through Notification No. 28/2023 – Central Tax dated July 31, 2023, any GST return will not be allowed to be filed after three years from its original due date.
This includes returns filed under:
- Section 37 (Outward Supply – GSTR-1, IFF),
- Section 39 (Payment of Tax Liability – GSTR-3B, GSTR-4, GSTR-5, etc.),
- Section 44 (Annual Return – GSTR-9, 9C),
- Section 52 (Tax Collected at Source – GSTR-7, GSTR-8).
GSTN Portal Implementation Date:
The GST portal will begin enforcing this rule starting with the July 2025 tax period, effectively barring the filing of any return for which the due date was in July 2022 or earlier.
✅ Illustrative Cut-off for Return Filing:
GST Return Form | Period to be Barred from Filing (w.e.f. August 1, 2025) |
---|---|
GSTR-1 / IFF | June 2022 |
GSTR-1Q | April–June 2022 |
GSTR-3B / M | June 2022 |
GSTR-3BQ | April–June 2022 |
GSTR-4 | FY 2021–22 |
GSTR-5 | June 2022 |
GSTR-6 | June 2022 |
GSTR-7 | June 2022 |
GSTR-8 | June 2022 |
GSTR-9 / 9C | FY 2020–21 |
🛑 What Taxpayers Need to Do:
All taxpayers are strongly advised to:
- Review and reconcile their filing records,
- Immediately file any pending GST returns dated back to or before June 2022,
- Ensure compliance before July 31, 2025, to avoid permanent restriction from filing.
This advisory is based on the earlier notice issued by GSTN dated October 29, 2024. Failure to comply could not only lead to penalties and interest but may also disrupt tax credits and compliance ratings.
📌 Final Word:
With the GSTN system auto-restricting filing for returns beyond three years from August 1, 2025, proactive compliance is not just recommended—it is mandatory.
Stay compliant. Stay ahead.
